ICN Ventures, Inc. (ICN) provides a number of online software products and services, including web and data hosting for its customers (Products), requiring the collection, storage and maintenance of information about Users, registrants, members and other users of Products (Users) necessary for access, processing and overall functioning of Products.
ICN only processes personal information for the purposes described in this Privacy Policy and/or a privacy notice associated with a specific service. In addition to the above, such purposes include: ICN processes personal information on secure servers in the United States of America. In some cases, ICN may process personal information on behalf of and according to the instructions of a customer, customer's client or other third party or partner of ICN.

Choices for Personal Information

When a User signs up for a particular Product that requires registration, ICN asks the User to provide personal information. If ICN intends to use this information in a manner different than the purpose for which it was collected, then ICN will ask for the consent of the User prior to such use.

If ICN proposes to use personal information for any purposes other than those described in this Policy and/or in other specific notices, ICN will offer the User an effective way to opt out of the use of personal information for those other purposes. ICN will not collect or use sensitive information for purposes other than those described in this Policy and/or in other specific notices, unless prior consent has been obtained from the User.

Users can decline to submit personal information to any Product, in which case ICN may not be able to provide that Product to the User.

Information Sharing

ICN does not in the normal operation and conduct of business share personal information with other companies or individuals outside of ICN and the particular customer or customer's client of ICN for which a Product has been implemented.

If ICN in good faith believes that access, use, preservation or disclosure of personal information is reasonably necessary to...
  1. Satisfy any applicable law, regulation, legal process or enforceable governmental request,
  2. Enforce applicable terms of service, including investigation of potential violations thereof,
  3. Detect, prevent, or otherwise address fraud, security or technical issues, or
  4. Protect against imminent harm to the rights, property or safety of ICN, its customers and customers' clients, users or the public as required or permitted by law.
...then ICN will provide notice before any personal information is used for such purposes.

If ICN becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, ICN will provide notice before any personal information is transferred and becomes subject to a different privacy policy.

ICN may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who used a particular Product, page, service or feature, for example, or how many users clicked on a particular link. Such information does not identify website visitors individually.

Information Security

ICN takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where personal data is stored.

ICN restricts access to personal information to ICN employees, contractors and agents who need to know that information in order to operate, develop or improve Products. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Data Integrity

ICN processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable specific privacy notice. ICN reviews its data collection, storage and processing practices to ensure that ICN only collects, stores and processes the personal information needed to provide or improve Products. ICN takes reasonable steps to ensure that the personal information being processed is accurate, complete, and current, but certain Products depend on the users of those Products to update and/or correct their personal information whenever necessary.

Accessing and Updating Personal Information

ICN makes good faith efforts to provide Users with access to their personal information and either to correct this data if it is inaccurate or to delete such data at the request of the User if it is not otherwise required to be retained by law or for legitimate business purposes. ICN Products may ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests. ICN may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be extremely impractical, or for which access is not otherwise required. In any case where Products provide information access and correction, ICN performs this service free of charge, except if doing so would require a disproportionate effort. Some Products have different procedures to access, correct or delete users' personal information. ICN provides the details for these procedures in the specific privacy notices or detail areas for each specific Product.

Enforcement

ICN regularly reviews its compliance with this Policy. Any questions or concerns regarding this Policy or ICN's treatment of personal information may be directed to ICN through ICN's website, www.notesbymail.com, or by writing to ICN at its corporate business address. All formal written complaints received at this address will be responded to specifically. ICN will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between ICN and an individual.

Changes to This Policy

This Privacy Policy may change from time to time. ICN will not reduce the rights of Users under this Policy without the explicit consent of said Users. ICN will post any Policy changes on its corporate website (www.notesbymail.com) and, if the changes are significant, will provide a more prominent notice (including, for certain Products, email notification of Policy changes). Each version of this Policy will be identified by its effective date. ICN will also keep prior versions of this Privacy Policy in its document archive for review upon request.
